Max Cleaner - Terms of Service

This Terms of Service (the "Agreement") is a legal agreement between you and Guangzhou Midong Technology Co., Limited ("we", "our", or "us") regarding your use of the Max Cleaner mobile application (the "App") and its related services (the "Service"). This Agreement does not apply to any third-party websites, services, or applications, even if they can be accessed through our Service.

By accessing or using the App, you acknowledge that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, please stop using the App immediately.

We may update or revise this Agreement from time to time due to product improvements or legal changes. The latest version will be available within the App. Continued use of the App after any updates constitutes your acceptance of the revised Agreement.

1. Intellectual Property Rights

The App, including all software, features, design elements, user interfaces, text, images, graphics, logos, and any related materials, is owned exclusively by us. All rights, titles, and interests, including copyrights, trademarks, patents, and trade secrets, remain our property.

You may not reproduce, distribute, sell, modify, adapt, or create derivative works of the App without our prior written consent.

You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, unless expressly permitted by applicable law or with our prior written approval.

Unauthorized use of the App may result in legal liability.

2. License to Use the App

We grant you a limited, personal, revocable, non-exclusive, and non-transferable license to download and use the App on a compatible mobile device for lawful, non-commercial purposes.

You agree not to:

• Use the App to create or promote competing products or services.
• Copy, resell, sublicense, lend, or otherwise distribute the App or any part of the Service.
• Interfere with or disrupt the App or the networks connected to it.
• Attempt to gain unauthorized access to the App, its servers, or related systems.
• Use the App in any manner that violates applicable laws or infringes upon the rights of others.

We reserve the right to suspend or terminate your access to the App if you violate this Agreement.

3. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and process your personal data. By using the App, you agree to the practices described in the Privacy Policy.

4. Email Cleanup and Gmail Access

The email cleanup feature is optional. If you choose to connect Gmail, Max Cleaner will request Google OAuth permission so the App can provide the email cleanup feature.

Max Cleaner accesses Gmail data solely to provide the email cleanup functionality requested by the user and does not use such data for advertising, marketing, user profiling, or unrelated analytics.

Max Cleaner does not sell, share, transfer, or use Gmail data for advertising, marketing, user profiling, analytics unrelated to the email cleanup feature, or any other unrelated purposes.

With your authorization, Max Cleaner may scan Gmail information, display emails for review, allow you to select unwanted emails, and move selected emails to Trash after your confirmation. Max Cleaner does not permanently delete Gmail messages. Selected emails are moved to Gmail Trash only after user confirmation.

Email information is processed locally on the user's device (on-device processing) for providing email cleanup functionality. Max Cleaner does not store email content on its own servers. Email information is not retained longer than necessary to provide the requested functionality.

You should carefully review selected emails before confirming any cleanup action. You are responsible for any email cleanup action you confirm in the App.

Emails moved to Trash may not be recoverable in all circumstances. Max Cleaner is not responsible for the loss of emails resulting from actions explicitly confirmed by the user.

You may disconnect Gmail access in Max Cleaner at any time. You may also manage or revoke Max Cleaner's access through your Google Account settings at any time. Once access is disconnected or revoked, Max Cleaner will no longer access your Gmail account unless you authorize it again.

5. Age Requirements

The App is intended for general users.

If you are a minor under the laws of your region, you should use the App under the guidance and supervision of a parent or legal guardian, who must review and accept this Agreement on your behalf.

6. Paid Services

Some features of the App may require payment ("Paid Services"). Payment methods are provided through third-party platforms, including the Apple App Store.

You agree to:

• Pay all fees associated with any Paid Services you purchase.
• Comply with the relevant terms and policies of Apple or other payment processors.
• Ensure that your payment method remains valid and up to date.

All purchases are final and non-refundable unless required by applicable laws or permitted by the App Store's policies.

If your payment fails or your payment method becomes invalid, we may suspend your access to Paid Services until updated payment information is provided.

7. Disclaimer of Warranties

The App and Services are provided on an "as is" and "as available" basis. We make no warranties regarding uninterrupted, error-free, or secure use of the App.

We are not responsible for issues caused by device failures, operating system limitations, network conditions, or other factors beyond our reasonable control.

We may update, modify, suspend, or discontinue any part of the App at any time without prior notice. We are not liable for any resulting impact on your use of the Service.

Any unauthorized or modified versions of the App may pose risks. We are not responsible for damages arising from the use of unofficial or altered versions.

To the fullest extent permitted by law, we disclaim all warranties not expressly stated in this Agreement.

8. Indemnification

You agree to indemnify, defend, and hold harmless Guangzhou Midong Technology Co., Limited, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

• Your use of the App or Service;
• Your violation of this Agreement;
• Any content or data submitted by you;
• Your violation of any applicable laws or third-party rights.

We reserve the exclusive right to assume the defense and control of any matter subject to indemnification.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict-of-law principles.

Any dispute arising out of or relating to this Agreement shall first be resolved through friendly negotiation.

If negotiation fails, the dispute shall be submitted to the China International Economic and Trade Arbitration Commission (CIETAC) for final and binding arbitration in accordance with its then-effective rules.

The arbitration shall take place in Shenzhen, China.
